The driver was later cited for DUI.

Police said the driver told officers on the scene that he was alone and wasn't carrying any passengers.

According to police, a woman was walking in the area at 6:51 a.m. when she saw a hand, leading to the discovery of Leiato's body.

The deceased passenger is identified as Fotu Tuli Leiato, age 21. Police responded and found the body.

The crash happened around 2:30 a.m. near Martin Luther King Junior Boulevard and Kinsrow Avenue. The auto, a 2014 Kia sedan, rolled off the road and into some heavy brush before coming to a stop.

The football program confirmed in May that Leiato had been dismissed from the program. His second arrest was in late April, and he faced charges of theft, criminal trespassing and criminal mischief, according to ESPN. In that incident, Leiato was accused of damaging and removing a parking boot from his vehicle. He also was charged in January for misdemeanor trespassing. "After arriving on campus as a linebacker, the 5'11", 198-pound Leiato got involved on special teams as a true freshman and ultimately shifted to safety as a sophomore.

He was expected to compete for a starting position at outside linebacker before his release.

Leiato played three seasons for Oregon.
